Overview

Theater Haven (“Theater Haven,” “we,” “us,” or “our”) operates theaterhaven.com and associated retail services (the “Services”). We sell home theater seating, recliners, sofas, entertainment centers, and related home furnishings through an online store supported by independent suppliers and fulfillment partners.

We respect the privacy of customers, prospective customers, and website visitors. This Privacy Policy explains how we collect, use, retain, safeguard, and disclose personal information when you access our website, communicate with us, create an account, place an order, request assistance, submit a review, or otherwise interact with the Services. It also explains available privacy rights and choices.

Our store is powered by Shopify, which enables us to operate the Services. Certain third parties also process information to provide payment, shipping, review, appointment, advertising, or other services. Where our Terms of Service and this Privacy Policy conflict concerning our treatment of personal information, this Privacy Policy governs that subject to applicable law.

For this policy, “personal information” means information that identifies, relates to, describes, or could reasonably be associated with an individual, as defined by applicable law. Not every section or right applies to every individual or jurisdiction.

1. Business Identity and Responsibility

Theater Haven operates the website https://theaterhaven.com and determines the purposes of ordinary customer-data processing connected with our retail business, subject to applicable law.

Shopify, payment processors, product suppliers, freight carriers, scheduling providers, and other providers may process personal information to supply our Services. Depending on their specific activities, they may act as processors or service providers for Theater Haven, or as independent organizations responsible for their own data practices.

Our customer support and privacy contact information, including our business mailing address, appears in Section 30.

2. Scope of This Policy

This Privacy Policy applies to information processed through our storefront, customer accounts, checkout, purchases, order fulfillment, freight delivery, returns, refunds, product questions, warranty-related assistance, customer service, reviews, website feedback, and appointment scheduling.

It also covers information processed through the website’s relevant cookies, analytics, advertising, and integrated ecommerce functions. Third-party websites and independent platforms reached through links from our site may be subject to separate privacy policies and terms.

3. Personal Information We Collect

Depending on how you interact with Theater Haven and which features are used, we may collect or process:

  • Identifiers and contact details: your name, email address, telephone number, billing address, shipping address, and customer or account identifiers.
  • Commercial and transaction records: products browsed, selected, added to a cart, ordered, returned, exchanged, or canceled; purchase amounts; order numbers; transaction dates; delivery instructions; order status; and warranty or return history.
  • Payment-related information: billing details, method of payment, payment confirmation, refund status, transaction identifiers, and limited payment details received from a provider. Full card credentials are ordinarily handled by the payment service rather than collected through Theater Haven’s general support communications.
  • Account information: customer-account identifiers, preferences, and authentication-related information managed by the account provider.
  • Communications and submitted content: messages, support inquiries, customer feedback, reviews, product questions, photographs, delivery information, and other material you submit to us.
  • Technical and device information: IP address, browser, operating system, device identifiers, cookie identifiers, network information, approximate region derived from technical data, and related records.
  • Website interactions: pages visited, referral sources, shopping-cart activity, product interests, website navigation, and interactions with storefront features.
  • Appointment information: name, email address, selected time, scheduling details, and information voluntarily provided when requesting a call.
  • Preferences and inferences: shopping interests or product preferences inferred from purchase or website activity where relevant features are used.

We do not necessarily collect every listed category from every visitor. The specific categories depend on the Services used, our technology settings, and applicable laws.

4. Sources of Personal Information

We collect personal information directly from you when you browse, order, register, schedule an appointment, submit a form, or contact us. We may also receive information automatically from browsers and devices through the Services, cookies, and similar technologies.

Other sources may include Shopify; payment and checkout providers; suppliers, distributors, fulfillment partners, and shipping carriers; customer-support, review, and scheduling services; and authorized marketing or analytics providers. We may receive information from other parties where you authorize a connection or a lawful disclosure occurs.

We may connect relevant records, such as an order number, delivery record, and customer service inquiry, to administer a purchase or resolve a legitimate service issue.

5. How We Use Personal Information

We use personal information for the following purposes, as relevant:

  • Operating our website and providing requested storefront features.
  • Verifying and processing orders, payments, cancellations, returns, and refunds.
  • Coordinating suppliers, warehouses, packaging, shipping, freight delivery, and delivery appointments.
  • Sending order confirmations, shipping updates, account notifications, and other transaction-related communications.
  • Responding to product inquiries, questions, complaints, support requests, and warranty matters.
  • Administering appointments, reviews, customer accounts, and submitted feedback.
  • Protecting accounts and transactions, preventing fraud, investigating abuse, and protecting the Services.
  • Evaluating website functionality, customer experience, product discovery, and technical performance.
  • Conducting marketing and advertising, where enabled and permitted, subject to required notice, consent, and opt-out rights.
  • Complying with applicable law, enforcing relevant terms, keeping necessary business records, and addressing legal claims.

Where legally required, we provide additional notice or obtain consent before processing information for a materially different purpose.

6. Legal Bases for Processing Where Applicable

Where the European Union General Data Protection Regulation (“GDPR”), UK GDPR, or comparable law applies, our legal bases may include performance of a contract, compliance with legal obligations, legitimate interests, and consent.

Contractual necessity may include processing a purchase, arranging delivery, and managing a refund. Legal obligations may include maintaining tax or legally required transaction records. Legitimate interests may include reasonable customer support, fraud prevention, security, dispute management, and service improvement, subject to applicable balancing rules. Consent may be required for certain marketing or nonessential tracking activities.

Where processing is based on consent, you may withdraw that consent through an available preference control or by contacting us. Withdrawal does not invalidate processing lawfully completed beforehand. Certain information may be necessary to provide a requested transaction or feature.

7. Purchases and Order Administration

We process order and contact details to verify purchases, identify merchandise, coordinate availability and shipment, process payment or refunds, provide support, and maintain records relating to your transactions.

We may contact you about an active order, delivery scheduling, billing concerns, returns, or other service matters. These operational notices are separate from promotional messages. Order records may also be used to respond to claims, resolve disputes, support warranty assistance, and meet legal recordkeeping obligations.

8. Product Suppliers, Dropshipping, and Fulfillment

Theater Haven uses a supplier-based retail and fulfillment model. Depending on the product, orders may be processed through independent suppliers or networks, including Shopify Collective and other vendor arrangements.

To fulfill a purchase, we may disclose necessary details to a manufacturer, supplier, distributor, warehouse, fulfillment partner, freight broker, delivery carrier, or other party participating in the transaction. Depending on the delivery, shared information may include your name, shipping address, telephone number, purchased items, quantity, order reference, delivery preferences, and relevant service instructions.

These parties may use information to confirm stock, prepare products, ship merchandise, schedule freight delivery, verify delivery conditions, investigate damage, handle replacements, arrange returns, and assist with warranty matters. Large furnishings may require a carrier to contact you to confirm a delivery window or access arrangements.

We seek to limit disclosures to information reasonably necessary to perform these activities. Independent suppliers and delivery providers may maintain their own records and have separate legal responsibilities and privacy practices.

Theater Haven remains the customer's retail point of contact for purchases made through our store, subject to our published order, shipping, and return terms.

9. Payment Processing and Financial Information

Payment transactions are facilitated through Shopify-supported checkout and payment service providers. These providers process financial credentials, authorize or decline payments, help prevent fraud, and manage refunds or payment disputes.

Our store generally receives transaction confirmation, payment status, transaction references, and limited billing details rather than complete payment card numbers or security codes. Payment providers may retain information in accordance with their own contractual, security, and legal requirements.

Do not send complete card numbers, card security codes, account passwords, or other sensitive payment credentials to our ordinary support email, contact forms, or appointment provider. Use the secure checkout or payment workflow provided for payment-related action.

10. Customer Accounts and Authentication

Customer account functionality, including Shopify customer accounts where available, may allow customers to view order history, access purchase details, manage certain preferences, and use account-related services.

Shopify or another authorized authentication provider may process login, account, and security-related information. Customers should protect access to their email and authentication methods and report suspected unauthorized account activity.

Requests to close, access, correct, or delete account information are subject to applicable law, the provider's capabilities, and necessary record-retention exceptions.

11. Customer Service and Product Inquiries

When you ask about a recliner, sofa, entertainment center, product dimensions, availability, delivery requirements, warranty, return, or order, we may use the details you provide to respond. This may include contact information, order numbers, product references, correspondence, and photographs of items or packaging.

To investigate a question or resolve a problem, we may share information relevant to the issue with suppliers, payment services, freight carriers, or warranty providers. We may retain support records for follow-up, service quality, dispute resolution, fraud prevention, and legitimate business purposes.

Please do not include unrelated sensitive personal information in ordinary support messages or uploads.

We may use AI-assisted receptionists and live telephone answering providers, including Smith.ai when activated, to respond to incoming calls, take messages, organize customer questions, arrange requested callbacks, and refer inquiries to our team. Depending on the features in use, these services may process caller telephone numbers, names, call dates and times, questions, message details, summaries, transcripts, and audio recordings. If calls are recorded or transcribed, we will provide appropriate notice and obtain any consent required by applicable law. Customers who do not wish to continue a recorded call may contact us through our customer-service email or website contact form. Please do not give payment card numbers, passwords, or other unnecessary sensitive data to a telephone receptionist.

12. Appointments and Scheduling Providers

Theater Haven may offer short product-assistance or customer-service appointments through an outside scheduling provider, including Calendly. If you book an appointment, the provider may process your name, email address, date, time, time zone, and details you voluntarily submit.

The scheduling provider may use data to administer availability, send booking confirmations or reminders, and operate its platform under its applicable privacy notice. We use booking details to carry out the requested consultation and appropriate follow-up, consistent with applicable communications and privacy requirements.

13. Customer Reviews and Website Feedback

Theater Haven uses or may use customer-review services, including Judge.me Reviews, to request, collect, manage, and display product feedback. Information may include ratings, review text, names or display names, email addresses, relevant purchase details, and voluntarily submitted photographs.

Material submitted through a public-review feature may be displayed to website visitors. Avoid including payment information, residential addresses, or other sensitive information in publicly visible review content.

Review providers may process information to verify purchases, request reviews, moderate misuse, and provide review technology. Requests concerning access, correction, or removal of personal information associated with reviews will be considered under applicable law and platform capabilities.

Website feedback submitted through our contact channels may also be used to investigate accessibility concerns, improve descriptions, or correct navigation and checkout issues.

14. Cookies and Similar Technologies

Theater Haven and its technology providers use or may use cookies, local storage, pixels, and related identifiers. Depending on their functions and our configuration, these technologies support:

  • Essential services: security, shopping carts, checkout, authentication, and core storefront operations.
  • Preference features: remembering choices and requested functionality.
  • Performance and analytics: evaluating website functionality and understanding use of the Services.
  • Advertising and personalization: advertising measurement, attribution, or tailored content where enabled.

Nonessential technologies are subject to relevant consent and preference requirements. You may also control cookies through your browser, although disabling essential technologies can interfere with purchases or account functionality.

For more detail, see our Cookie Policy and available storefront privacy controls.

15. Analytics, Site Performance, and Security Monitoring

We may process IP addresses, technical identifiers, page views, referral information, product and cart interactions, approximate location inferred from network data, and technical error reports to understand the operation of our website and to improve its usability and reliability.

Such information can also support fraud detection, account and transaction security, abuse investigations, and system protection. Where appropriate, analytics may be aggregated, deidentified, or pseudonymized. Third-party providers may help operate these functions under applicable agreements and privacy requirements.

16. Advertising, Measurement, and Personalized Content

Theater Haven may promote products on search engines, shopping services, social-media platforms, and other advertising networks. When relevant advertising technology is enabled, it may process online identifiers, product interests, page activity, purchase events, and advertising interactions to measure campaigns or provide relevant advertising.

Some advertising technologies rely on activity across websites, merchants, or services. Depending on applicable law, related transfers may be considered “sharing,” “selling,” or processing for “targeted advertising” even when no payment is received for personal information.

Our use of such technologies is subject to available settings, applicable consent and opt-out requirements, and the choices described below. We do not treat marketing and necessary purchase-related communications as interchangeable.

17. Marketing and Service Communications

We may send transactional communications about purchases, shipments, delivery arrangements, order changes, refunds, accounts, returns, warranties, and security. These necessary messages are separate from promotional communications.

We may send promotional email or other marketing communications when permitted by law and, when required, with consent. You can unsubscribe from promotional email using the opt-out mechanism in the message or by contacting us. If text-message marketing is offered, applicable consent and opt-out procedures will apply.

Even after unsubscribing from marketing, you may continue to receive operational notices relating to a purchase, account, or legitimate service matter.

The telephone number you provide for checkout, delivery scheduling, a requested callback, or customer support does not by itself enroll you in promotional calls or texts. Where we offer optional text-message promotions, we collect channel-specific consent through a separate opt-in, record consent and unsubscribe preferences, and share only information needed with the messaging platform and telecommunications providers to deliver and administer permitted messages. You may withdraw marketing-text consent using the instructions in the message or by contacting us. Email marketing permission is separate from text marketing permission. We will not treat a service inquiry or transaction as blanket permission to place automated or AI-voice promotional calls.

18. Shopify Hosting and Enhanced Services

The Services are hosted by Shopify, which processes personal information concerning access to, use of, and transactions through our store to provide, secure, support, and improve ecommerce services. Information submitted through the Services is transmitted to Shopify and other relevant service providers, which may be located in countries other than your own.

Shopify also offers enhanced features that may use information from your interactions with our store together with information about interactions with other Shopify merchants and Shopify services. When used, these features can help with personalization, fraud prevention, improving services, evaluating how customers interact with stores and advertising, and showing relevant advertisements.

To operate such Shopify Enhanced Services, Shopify may process data from Theater Haven, other merchants, and Shopify in accordance with its own responsibilities. When Shopify determines its own purposes and means of processing for these features, Shopify is responsible for that processing and for applicable rights requests concerning it.

For more information, visit the Shopify Consumer Privacy Policy and Shopify Privacy Portal. Depending on where you reside, you may exercise choices about Shopify's relevant processing through the portal or other available methods.

Some Shopify Enhanced Services may involve sharing or targeted advertising under certain U.S. state laws, or require appropriate consent for relevant activities in the European Economic Area, United Kingdom, or Switzerland. We provide our applicable privacy opt-out link in Section 20.

19. Third Parties With Whom We Disclose Information

We may disclose personal information to categories of recipients necessary for legitimate operations or otherwise permitted or required by law:

  • Shopify and ecommerce providers: hosting, checkout, customer accounts, storefront functionality, and associated services.
  • Payment processors and financial partners: payment authorization, transactions, refunds, fraud investigation, and payment disputes.
  • Manufacturers, suppliers, distributors, warehouses, and fulfillment partners: inventory confirmation, product fulfillment, returns, replacements, and warranty support.
  • Carriers, freight services, and logistics providers: shipping, delivery scheduling, tracking, and problem resolution.
  • Customer-support, communications, scheduling, and review providers: responding to inquiries, managing customer messages, booking appointments, and collecting feedback.
  • Analytics and advertising providers: performance measurement, advertising functions, and related services where enabled and lawful.
  • Professional advisers and authorities: accounting, legal, audit, compliance, and other matters where reasonably necessary or legally required.
  • Parties to a legitimate business transaction: a merger, acquisition, restructuring, financing, or asset transfer, subject to appropriate protections.

We seek to limit each disclosure to information reasonably necessary for its intended purpose. Different recipients may act on our instructions or as independent organizations with their own legal duties.

When enabled, telephone-answering and messaging service providers may include Smith.ai, Shopify Messaging, telephone carriers, and related technology providers. These providers receive only information reasonably needed to deliver the services we use, such as contact details, call or message records, transcription or summary data, marketing-consent status, and opt-out instructions, subject to applicable provider agreements and law.

20. Sales, Sharing, Targeted Advertising, and Opt-Out Choices

Certain privacy laws define “sale” and “sharing” to include the disclosure of online identifiers or interaction data to advertising partners for cross-context behavioral advertising, even where a merchant does not receive money in exchange for that information. Depending on our actual advertising settings and applicable law, some disclosures may be subject to opt-out rights.

Where you have applicable rights, use our Your Privacy Choices page to request that qualifying information not be sold or shared for such advertising or processed for targeted advertising. The effect may depend on whether the request relates to your browser, device, or identifiable customer account.

Where legally required and supported by the relevant technology, a recognized Global Privacy Control preference signal will be treated as an opt-out request for the browser or device transmitting it and may be associated with an account where the system can do so appropriately. Other browser “Do Not Track” signals generally do not operate as a standardized opt-out mechanism unless law requires otherwise.

Opting out of advertising-related activities does not prevent information from being used to fulfill orders, process payments, provide customer support, prevent fraud, or meet legal obligations.

21. Sensitive Personal Information

Our ordinary retail operations do not require customers to provide Social Security numbers, medical records, account passwords, or similar highly sensitive information directly to Theater Haven customer-support representatives. Please do not send such information through ordinary email or website contact forms.

Payment or authentication service providers may process financial or account credentials as necessary to provide secure services. If information classified as sensitive under applicable law is processed, we will apply the relevant purpose limitations and safeguards and honor eligible rights to limit certain uses or disclosures.

22. Retention of Personal Information

We retain information for as long as reasonably necessary for the purposes described in this Privacy Policy, taking into account the nature of the information, the relationship involved, the applicable provider, and relevant legal obligations.

  • Purchase and accounting records: for required tax, financial, transaction, dispute, and legal recordkeeping periods.
  • Customer account information: for the account relationship and any necessary period following closure for security, legal, or service purposes.
  • Support, delivery, return, and warranty records: for the time appropriate to complete assistance, administer product obligations, investigate complaints, and defend or resolve claims.
  • Scheduling information: to administer the appointment, conduct requested follow-up, and meet legitimate recordkeeping needs.
  • Cookie, analytics, advertising, and security information: according to relevant settings, technical lifetimes, consent choices, provider retention practices, and lawful operational needs.

Information may need to be retained longer where a legal obligation, pending dispute, investigation, or other permitted exception applies. We seek to delete, deidentify, or securely dispose of information when it is no longer reasonably needed, subject to system capabilities and applicable law.

When call recording or transcription is enabled, call audio, transcripts, summaries, and related support logs may be retained by the service provider according to its current retention settings and applicable law. Retention periods can differ between the provider dashboard and any records we lawfully keep for customer support, disputes, or legal obligations. Contact us if you have questions about available records or privacy rights.

23. Data Security and Customer Precautions

We use Shopify and other service providers for secure ecommerce operations and employ reasonable technical and organizational measures appropriate to the data involved. Depending on the system, such safeguards may include encrypted connections, managed checkout systems, authentication controls, access restrictions, transaction monitoring, and fraud-prevention tools.

No website, information system, or transmission method can guarantee absolute security. You should protect account and email credentials, avoid using unsecured channels to transmit sensitive details, and promptly inform us of suspected unauthorized activity concerning your account or purchase.

If a security incident occurs, we will assess and respond to applicable notification, remediation, and other legal obligations.

24. International Processing and Transfers

Shopify and other service providers may store, transfer, or otherwise process personal information in countries other than the one where you live. Data-protection laws in those countries may differ.

Where legally required for transfers from the European Economic Area, United Kingdom, Switzerland, or another protected jurisdiction, we rely on appropriate transfer mechanisms such as adequacy determinations, approved standard contractual clauses, or other legally recognized safeguards. You may contact us with questions about applicable transfer protections.

25. Your General Privacy Rights

Depending on your place of residence and applicable law, you may have rights to request:

  • Information about the categories and purposes of personal information collected, used, or disclosed.
  • Access to personal information we maintain about you.
  • Correction of inaccurate information.
  • Deletion of eligible information, subject to lawful exceptions.
  • A portable copy of certain information.
  • Restriction of, or objection to, certain processing.
  • Opt-out of eligible sale, sharing, or targeted advertising processing.
  • Withdrawal of consent when processing relies on consent.
  • Review or appeal of certain privacy-request decisions when legally available.

To exercise available rights, contact us using Section 30 or use an applicable privacy preference tool linked on the website. We may need to verify your identity or an authorized agent's authority to avoid disclosing or changing information improperly. We respond within applicable legal timeframes and do not unlawfully discriminate against individuals for exercising their rights.

Some rights are limited by legal exceptions, including necessary business records, security obligations, existing transactions, or other permissible purposes.

26. California Privacy Rights

If the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the “CCPA”), applies to Theater Haven and a California resident's information, the resident may have additional rights to know, access, correct, delete, obtain a portable copy, opt out of qualifying sale or sharing, and limit certain uses of sensitive personal information.

Personal information categories potentially relevant to our retail operations include identifiers; customer and payment-related records; commercial information; internet or electronic-network activity; communications; and relevant inferences about shopping interests. These are explained in Section 3, with sources in Section 4, uses in Sections 5–18, types of recipients in Section 19, and retention criteria in Section 22.

Where our configured advertising or enhanced-service features involve practices treated as a sale or sharing under the CCPA, eligible individuals may use the Your Privacy Choices page. We may verify access, deletion, or correction requests as allowed by law, and we will not unlawfully discriminate against individuals for using protected rights.

Specific statutory disclosure requirements, including precise lookback-period categories and uses, depend on the practices actually in place and whether the CCPA's applicability thresholds are met. This section does not represent that every California requirement applies in circumstances where its statutory conditions are absent.

27. Privacy Rights in Other U.S. States

Residents of other states with applicable comprehensive consumer privacy statutes may have rights relating to access, correction, deletion, portability, targeted advertising, qualifying sales of data, or certain profiling activities.

If an applicable law provides a right to appeal a privacy decision, you may submit an appeal by contacting us, identifying the original request and the decision you wish to contest. We will respond and provide any required information about further recourse under the applicable law.

Business applicability, defined categories, exceptions, and individual rights differ between jurisdictions. We assess requests under the law relevant to the requester and processing activity.

28. European, UK, and Swiss Privacy Rights

Where the GDPR, UK GDPR, or Swiss data-protection law applies, you may have rights of access, rectification, erasure, restriction, objection, portability, and withdrawal of consent where applicable. You may also have rights concerning certain decisions based solely on automated processing that produce legal or similarly significant effects.

Potential legal bases for our processing are described in Section 6, and international transfer measures are addressed in Section 24. You may submit a request through the contact information in Section 30 and may have the right to complain to a competent data-protection authority.

Where legally required, additional information about a designated representative or specific processing safeguards will be provided.

29. Children, External Services, and Policy Changes

Children's privacy. Our Services are intended for general retail customers and are not directed to children under age 13. We do not knowingly solicit personal information from children under 13. A parent or guardian who believes a child has submitted information may contact us to request appropriate review or deletion. As of the last update of this policy, we do not have actual knowledge that we sell or share the personal information of individuals under age 16 as those terms are defined under applicable law.

External services. Our website may include links to independent sites or services, including scheduling tools, supplier-related information, Shopify services, or social-media platforms. Those entities may follow their own privacy notices. Linking to a website does not mean Theater Haven controls its independent processing.

Corporate and legal events. Information may be used or disclosed where reasonably necessary for lawful litigation, regulatory requests, mergers, acquisitions, reorganizations, or transfers of assets, subject to applicable legal restrictions and safeguards.

Changes to this policy. We may revise this policy as our services, providers, technology, practices, or legal obligations change. We will publish revised language, update the “Last updated” date, and provide additional notice where legally required.
