Terms and Conditions

Overview

Welcome to Theater Haven. These Terms and Conditions govern purchases made through our online store and use of our website, including orders for furniture, home theater equipment, electronics, entertainment furnishings, and related products. They describe purchasing terms, delivery considerations, customer rights, and the responsibilities of customers and Theater Haven.

By using the website or placing an order, you accept these Terms to the extent enforceable by law. Product-specific representations and conditions communicated before purchase also apply to that transaction. Nothing in these Terms removes rights or remedies that a customer cannot legally waive.

01. Acceptance and scope

These Terms & Conditions govern use of theaterhaven.com and purchases made from Theater Haven. “Theater Haven,” “we,” “our,” and “us” refer to the retailer operating this online store. “You” refers to a visitor, customer, or account holder. Please review these terms before ordering. Using the site or placing an order constitutes acceptance to the extent enforceable under applicable law.

These Terms do not waive consumer rights that cannot legally be excluded or restricted. If you have a question about a condition that could affect your purchase, contact us before placing your order.

02. Related policies and order-specific terms

Our Shipping & Delivery Policy, Return & Refund Policy, Billing Terms & Conditions, Warranty Information, and Privacy Policy provide additional information. Material product-specific conditions disclosed before checkout also apply to that item.

If a product-specific disclosure and a general description appear inconsistent, contact us before ordering. Any non-waivable legal right prevails over a conflicting provision, and we will not impose an undisclosed post-purchase condition that deprives you of rights or benefits promised when you ordered.

03. Who we are and what we sell

Theater Haven is an independent online retailer focused on home theater seating, recliners, sofas, sectional furniture, entertainment centers, media furnishings, electronics, and selected home accents. We arrange fulfillment through participating manufacturers, distributors, wholesalers, and other supply partners. Products may be shipped by a supplier rather than from a Theater Haven-owned warehouse.

A brand name or photograph on our site identifies merchandise, not necessarily an endorsement of, affiliation with, or authorized-dealer relationship with that brand. We will not claim a particular authorization or manufacturer warranty unless the product information and supplier relationship support it.

04. Eligibility and lawful purchasing

You must have the legal capacity to enter into a purchase contract in your jurisdiction or act with the authorization of a person who does. You agree not to place an order using another person's payment information, identity, or account without permission.

We may decline a transaction where required to comply with law, sanctions, payment-security requirements, or reasonable fraud-prevention measures. Any refusal or cancellation will be handled consistently with applicable payment and refund obligations.

05. Customer accounts and credentials

Creating an account is optional unless a particular service requires sign-in. If you open an account, you are responsible for keeping login credentials confidential and notifying us promptly if you suspect unauthorized access. Do not share passwords or payment credentials through our contact forms.

Your account may show order history and available delivery updates. An account display does not replace the written order confirmation or any material terms communicated for your order. We may restrict abusive or compromised account access using proportionate security measures.

06. Accuracy of customer information

Please provide complete and accurate contact, billing, and delivery information and keep it current. Incomplete addresses, incorrect phone numbers, or inaccessible delivery locations may cause delays, rescheduling, or additional carrier charges that will be disclosed where applicable.

We will attempt to contact you using the information you provide when we need to verify an order, arrange freight delivery, resolve stock issues, or communicate a shipment delay. If you notice an error, notify us as soon as possible.

07. Product listings and specifications

We endeavor to accurately display each product's manufacturer, model, dimensions, material, finish, controls, power requirements, included components, available configurations, and current price. Some details originate with independent suppliers and may be updated as verified information becomes available.

Descriptions are not substitutes for specifications that must be confirmed for your intended use. If a listing does not clearly state a feature, compatibility requirement, accessory, or warranty term that matters to you, request clarification before ordering. We will not knowingly substitute a materially different product without your agreement.

08. Images, finishes, and representations

Product photographs are intended to illustrate the merchandise. Screen brightness, photography, room lighting, and individual material variations can affect how colors and textures appear. Lifestyle staging, decorative props, accessories, and room furnishings are not included unless the listing says they are.

Where a listing uses digitally enhanced or staged imagery, those images must not materially misstate the actual product. Consult the product's stated specifications and the images identifying the item itself; ask us if a pictured feature is unclear.

09. Dimensions and room suitability

Furniture dimensions can vary by configuration and manufacturing tolerances. Before purchase, measure the intended placement area along with all doorways, corridors, stairwells, elevators, and other access points. Check recliner clearance, fully extended length, sectional orientation, media-console depth, and the clearance required for doors or drawers.

Verify installation-space conditions such as flooring, wall clearance, ventilation, mounting surfaces, and power-outlet location. We will help interpret available specifications, but customers and their chosen installers should independently verify site measurements and suitability for a particular space.

10. Product safety, electrical features, and instructions

Some seating or entertainment products may contain motors, heating or massage features, powered reclining controls, lighting, built-in speakers, USB ports, wireless charging, or other electrical equipment. Follow the product's supplied instructions, safety warnings, weight limits, power requirements, and care directions.

Do not modify electrical components, overload power connections, or operate damaged equipment. Installation, furniture anchoring, and assembly should follow manufacturer instructions and applicable safety requirements. Contact us for available documentation if instructions are missing.

11. Prices, currency, and corrections

Prices shown in the store are displayed in the indicated currency, ordinarily U.S. dollars for orders placed through our U.S. storefront. A listed price does not necessarily include taxes, separately identified delivery upgrades, or other charges unless expressly stated. The checkout summary is intended to display the amount you are authorizing.

Occasionally an error may affect price, availability, or specifications. If a material error is discovered before an order is fulfilled, we will contact you to explain the issue and the available resolution. We will not add a higher price to an accepted order without your agreement, and any cancellation or refund will respect applicable law.

12. Promotions, discounts, and advertised savings

Promotions, discounts, coupons, gifts, and special offers apply only where their stated eligibility rules are met. Any exclusions, end dates, quantity limitations, or restrictions on combining offers should be made available with the offer before purchase.

An advertised saving or comparative price must have a truthful basis. A promotion does not override legally required disclosures, agreed order terms, or a supplier-specific restriction that we have failed to disclose before purchase. If an offer is unclear, ask us for written confirmation.

13. Taxes and additional charges

Applicable sales taxes and other government-imposed charges are calculated or disclosed according to checkout settings, location, and law. Freight upgrades, assembly, room-of-choice delivery, and similar services may carry separately identified fees when offered.

We do not expect customers to pay a new, undisclosed charge after checkout without first receiving an explanation and an opportunity to agree or pursue an appropriate alternative. International duties or special destination charges apply only where clearly disclosed and legally applicable.

14. Placing orders and order acceptance

Submitting a checkout order is a request to purchase the identified products on the stated terms. You will generally receive an electronic acknowledgment. Acknowledgment of submission is not a guarantee that the supplier has reserved inventory or that every fulfillment condition has been satisfied.

Order acceptance and performance remain subject to legitimate inventory verification, payment authorization, delivery eligibility, and applicable law. When an order cannot be supplied on the represented terms, we will promptly contact you regarding lawful alternatives, consent to a change, cancellation, or refund as appropriate.

15. Inventory, availability, and discontinued items

Stock indicators and estimated inventory can change quickly and may depend on supplier systems. An item displayed on the site can become unavailable before fulfillment confirmation. Products may also be discontinued or temporarily backordered by manufacturers.

If an ordered product is unavailable, we will not automatically ship a replacement, upgrade, different color, or substitute model without obtaining your agreement to the material change. We will communicate the available options and process any required refund for goods that cannot be supplied.

16. Order modifications and customer cancellations

Contact our support team promptly if you need to change a size, finish, configuration, quantity, delivery address, or order. Changes may be limited once a supplier has accepted the order, begun special handling, or transferred merchandise to a carrier.

Cancellation eligibility and any lawfully applicable costs depend on the product, fulfillment status, the conditions clearly disclosed before purchase, and your legal rights. We will explain the available options rather than automatically imposing an undisclosed cancellation charge. Shipment-delay cancellation rights remain available where required by law.

17. Payment methods and authorization

Purchases are processed using the payment methods shown in our Shopify checkout. Payment processors may perform authorization, verification, or fraud checks. A temporary card authorization is not necessarily the same as a finalized charge, and the timing of payment capture can depend on the method used.

Only use payment instruments you are authorized to use. We do not request full card numbers, banking passwords, or security codes through email, chat, or customer-service forms. Contact your payment provider about its particular billing-cycle or authorization rules.

18. Financing and installment providers

Where a buy-now-pay-later, installment, or financing option is displayed, it is provided under the terms of the relevant third-party financing company. Availability, underwriting, interest, charges, repayment schedules, and approvals depend on that provider and the specific offer presented to you.

Theater Haven cannot promise financing approval or a particular monthly payment unless the provider's offer confirms it. Review the financing disclosures and understand how returns, cancellations, partial refunds, and disputed transactions affect your payment obligations to the provider.

19. Delivery destinations and shipping options

Delivery is available to destinations supported for the particular item and supplier. Oversized furniture, special-access locations, remote destinations, and certain residential addresses may have service limitations. Available shipping methods and any qualifying free-standard-delivery offer are determined for the item and destination.

Free standard shipping, where advertised and applicable, does not automatically include expedited transport, white-glove handling, unpacking, assembly, stairs, special equipment, or other optional services. Review checkout and the Shipping & Delivery Policy before completing the purchase.

20. Processing times, shipment dates, and delays

Order processing time, carrier transit time, and final delivery time are different measurements. Any shipment or delivery estimate must have a reasonable basis. Estimates may vary by supplier, inventory, carrier route, destination, and freight scheduling, and we will not represent an unverified 7–15-day delivery promise as universally guaranteed.

If we cannot ship merchandise within a promised shipment period, we will provide the notifications, cancellation options, and refunds required by applicable law, including the FTC Mail, Internet, or Telephone Order Merchandise Rule where it applies. If no shipment time has been stated, that Rule generally establishes a 30-day shipment standard and related delay obligations. These are shipment requirements, not a promise that freight will arrive within 30 days.

21. Freight, appointments, and delivery services

Large or heavy products may require a freight carrier, delivery appointment, curbside service, threshold service, or a specified receiving area. Room-of-choice placement, installation, assembly, packaging removal, and white-glove service are included only when expressly confirmed for that order.

Customers should disclose known restrictions such as stairs, narrow entries, gated access, parking limits, elevators, or other site conditions that could affect an agreed delivery method. If an unsuccessful delivery or redelivery fee is possible, we will seek to disclose it before purchase or before you authorize a new delivery arrangement.

22. Receiving your order and visible damage

At delivery, examine the outer packaging and merchandise as reasonably possible before acknowledging receipt, particularly for freight shipments. Photograph any visible damage, missing cartons, or apparent wrong items, and note concerns with the carrier where permitted. Keep packaging and documents until a problem is resolved.

Notify Theater Haven promptly with your order number and supporting photographs so we can investigate with the supplier or carrier. Prompt reporting helps preserve evidence, but a failure to follow a suggested inspection step does not automatically extinguish statutory rights, valid warranty coverage, or remedies that cannot legally be waived.

23. Title, ownership, and risk of loss

Transfer of title and responsibility for loss or damage is determined by the applicable sales contract and governing law, including any mandatory consumer-protection rules. Shipment tracking showing carrier acceptance does not by itself override the legal allocation of risk or excuse our responsibility to address an unfulfilled or damaged order.

If a shipment is lost, misdelivered, or damaged before delivery is completed, contact us with the order details. We will investigate and explain the appropriate replacement, refund, claim, or other remedy consistent with the applicable terms and law.

24. Returns and exchanges

Return eligibility, request windows, required condition, packaging, shipping arrangements, and any lawful restocking or freight charges are governed by the Return & Refund Policy and material item-specific conditions made available before purchase. Not every supplier permits the same type of change-of-mind return.

Do not ship merchandise to an unconfirmed address. Begin a return request through Returns & Exchanges or contact our customer-service team for instructions. Any return promise presented to you before purchase will be honored according to its stated terms and applicable law. We will not apply an undisclosed restriction retroactively to a completed order.

25. Refund processing and charges

When a refund is owed, we will explain the basis, amount, applicable deductions if legally permitted and properly disclosed, and the expected processing path. Refunds are generally directed through the original payment method unless another lawful arrangement is agreed.

Bank or financing-provider posting time can differ from when we initiate the refund. We will not withhold a refund that is legally required because a carrier or supplier has not completed an internal process when applicable law requires us to act. See the Return & Refund Policy for further details.

26. Wrong, defective, incomplete, or damaged merchandise

If an item arrives incorrect, incomplete, damaged, or apparently defective, contact us with the order number, product details, and photographs when feasible. We will work with the applicable supplier or manufacturer to evaluate the facts and advise on available repair, replacement, return, refund, or other appropriate resolution.

Rights involving defective or misdescribed goods may be different from rights for a change-of-mind return. Nothing in these Terms restricts remedies the customer is entitled to under non-waivable law. We will not require a customer to accept a substitute item materially different from the ordered product.

27. Manufacturer warranties and support

Manufacturer, distributor, or supplier warranties, if available, are specific to the product and the applicable warranty document. Duration, parts and labor coverage, exclusions, registration rules, and claim-handling procedures can differ among brands or models. Theater Haven does not provide a blanket manufacturer warranty for all items.

Review Warranty Information and any listing-specific warranty details. Contact us if you need clarification about which organization administers a claim. We will not describe ourselves as an authorized dealer unless that relationship is documented.

28. Assembly, installation, and independent contractors

Unless expressly included in the order, assembly, mounting, furniture anchoring, electrical work, wall preparation, and installation are not part of a furniture purchase. Where an independent provider performs additional services, the scope and responsibility for that service must be separately described.

Customers should use qualified personnel when required for safe installation and follow the actual manufacturer's instructions. Theater Haven will not imply that product purchase alone includes an electrical, construction, or professional installation service.

29. Website access and prohibited activity

You may browse and use the store for lawful shopping and customer-service purposes. You must not introduce malicious code, interfere with checkout systems, scrape or overload the service unlawfully, attempt unauthorized access, impersonate another person, or submit fraudulent orders, reviews, or support requests.

We may restrict access or investigate conduct that reasonably threatens security, other customers, or legitimate store operations, subject to applicable law. This section does not prevent lawful consumer complaints, reviews, reporting of security issues, or exercise of legal rights.

30. Respectful Communication and Customer Conduct

Theater Haven is committed to maintaining a professional and respectful environment for customers, employees, representatives, and business partners.

We do not tolerate harassment, threats, intimidation, discriminatory abuse, or repeated hostile or abusive communications directed toward our team or others involved in providing our services. This standard applies to communications by email, telephone, website messaging, reviews, and other customer interactions.

Theater Haven reserves the right to end abusive communications, restrict communication channels, or take other reasonable measures to protect its representatives and business operations. Such measures will be applied fairly and in accordance with applicable law. They do not eliminate existing contractual obligations, legitimate customer complaints, refund eligibility, or legally protected consumer rights.

31. Store content, brands, and intellectual property

Site design, original copy, photography, logos, and other original materials may be protected by copyright, trademark, or other intellectual-property laws. Some product descriptions, images, and brand assets are supplied by third-party rights holders. All such rights remain with their respective owners.

Purchasing furniture does not grant rights to republish protected site content or impersonate Theater Haven or another brand. Normal personal use of publicly available shopping information, lawful quotation, and other rights permitted by law remain unaffected.

32. Reviews, feedback, and customer submissions

We may offer forms for product inquiries, site feedback, and experience reviews. Submissions should be truthful, relevant, and free of another person's confidential information or content you lack authority to share. Do not submit payment credentials or sensitive health information in free-text fields.

Submitting a private feedback form does not automatically make your comments public. If we wish to publish identifiable feedback or a testimonial, we will follow applicable consent and review-transparency requirements. We will not fabricate endorsements or condition an earned review on favorable sentiment.

33. Privacy, cookies, and customer data

Our Privacy Policy and Cookie Policy explain relevant data practices and technologies. Checkout, order management, customer service, and analytics may involve Shopify and other service providers as disclosed by those policies.

Use Your Privacy Choices for available privacy requests. Any consent or opt-out rights required by applicable law remain in force. These Terms should not be interpreted as blanket permission for optional marketing communications.

34. Electronic notices and communications

By placing an order or creating an account, you agree that order acknowledgments, shipping notices, customer-service replies, and other transaction-related messages may be delivered electronically when legally permitted. Keep your email address and contact information current so we can reach you about the order.

Transactional messages are distinct from optional promotional email or text marketing. Marketing messages require whatever permissions applicable law requires; you may exercise applicable unsubscribe and preference rights.

Incoming customer calls may be answered by a third-party AI-assisted receptionist or a live telephone agent acting for Theater Haven. We may use such services for answering questions, taking messages, and coordinating requested follow-ups. Where calls are recorded or transcribed, we will provide notice and address consent requirements under applicable law. Asking us for a callback authorizes a response to that request, but is not consent to unrelated promotional calls or texts.

If we offer optional Theater Haven promotional SMS messages, enrollment requires an affirmative and separate choice. Promotional message frequency varies with our offers, including periods with no messages. Message and data rates may apply. You may opt out at any time through the unsubscribe instructions in a text message, by replying STOP where that option is supported, or by contacting help@theaterhaven.com; for help, use the instructions in the message or contact that email address. Consent to marketing texts is not a condition of purchase. Permission for email promotions is separate. We will not send automated or AI-voice sales calls without the applicable legally sufficient permission.

35. Shopify, third-party links, and external services

Our store uses Shopify and may offer links or services operated by independent payment providers, financing companies, shipping carriers, customer-support platforms, or product manufacturers. Those providers may have their own applicable contracts and privacy practices, which should be reviewed where relevant.

A reference or link does not necessarily mean Theater Haven owns, controls, or endorses a third-party website. Where a third party supplies a service directly to you, we will explain the relationship to the extent material to the transaction.

36. Service interruptions and security

We work to maintain reasonable website access and accurate information, but the website may occasionally experience outages, maintenance, software errors, or other disruptions. We may correct technical issues and update functionality in ways that do not improperly alter accepted order terms or consumer rights.

No website or online transmission is completely risk-free. If you suspect account compromise or an unauthorized charge, contact the appropriate payment provider and our customer-service team promptly.

37. Product and website warranties; legal rights

Except for express promises contained in a product listing, an accepted order, a valid product warranty, or applicable law, we do not make additional guarantees that the website will be uninterrupted or that every product will suit every unstated purpose. General advice does not replace a written manufacturer specification or a qualified installation assessment.

This clause does not exclude statutory warranties, guarantees, product-safety obligations, or rights arising from inaccurate descriptions, defective goods, or other matters that cannot legally be waived. Any limitation applies only to the extent permitted by governing law.

38. Limits on liability and available remedies

To the extent the law permits, Theater Haven is not responsible for purely speculative losses or indirect harm caused solely by events outside our reasonable control. This provision is not intended to excuse a failure to deliver paid-for merchandise, conceal a defect, misrepresent a product, or provide a refund or other remedy required by law.

Nothing in these Terms excludes liability that cannot be excluded, including liability arising from fraud or other conduct for which an exclusion is unlawful. Any remedy and any lawful limitation on liability will be governed by the applicable agreement and law, including non-waivable consumer-protection requirements.

39. Events outside reasonable control

Severe weather, natural disasters, carrier disruptions, labor interruptions, outages, government actions, and similar events may affect processing or delivery. We will communicate material developments when practicable and work toward an appropriate resolution.

These circumstances do not eliminate duties to provide legally required shipment-delay notices, cancellation opportunities, refunds, or other non-waivable consumer remedies.

40. Indemnification for unlawful misuse

To the extent permitted by law, you agree to defend and indemnify Theater Haven and its officers, employees, and agents against third-party claims, damages, liabilities, and reasonable legal costs directly arising from your fraudulent use of the website, unauthorized use of another person's account or payment information, unlawful interference with our services, or your submission of material that infringes another person's legally protected rights.

This obligation does not apply to losses caused by Theater Haven's own negligence, wrongdoing, misrepresentations, contractual breach, defective merchandise, or failure to meet duties imposed by law. It is not intended to shift our ordinary responsibility for legitimate orders or to prevent you from making lawful complaints, seeking refunds, exercising chargeback rights, or pursuing legal remedies. We will give reasonable notice of an indemnified claim and permit appropriate participation in its defense as required by law.

41. Good-faith resolution and Michigan arbitration

Theater Haven and the customer will first make a good-faith effort to resolve disputes relating to an order, these Terms, or use of the website by communicating the nature of the concern and the resolution requested. Either party may submit a written description of a dispute through the contact information in these Terms. The parties may agree on a reasonable period to attempt an informal resolution, without delaying urgent relief or any legal right that cannot be waived.

If a dispute remains unresolved, binding arbitration is the preferred and agreed method of dispute resolution to the extent permitted by applicable law, except for matters eligible to proceed in small-claims court or matters that cannot legally be subjected to arbitration. The arbitration will be conducted by an independent, impartial arbitrator selected by mutual agreement of the parties. These Terms do not require use of any particular arbitration association, institution, or commercial administrator.

If the parties cannot agree on an arbitrator or the agreed selection method fails, either party may seek appointment of a neutral arbitrator by a court with jurisdiction as permitted by the Federal Arbitration Act, including 9 U.S.C. § 5 where applicable, and the Michigan Uniform Arbitration Act, including Michigan Compiled Laws § 691.1691 where applicable. The arbitrator's authority and the conduct of the proceeding are subject to applicable law and any fair procedures separately agreed upon by the parties.

Michigan is the preferred location for arbitration. However, the parties may agree to remote proceedings, written submissions, or another reasonable location, and no provision requires a consumer to travel to Michigan where mandatory law prohibits that requirement. Arbitration costs, administrative charges, and arbitrator fees will be handled in accordance with applicable law and any mutually agreed lawful procedure. A final arbitration award may be entered in a court with jurisdiction. Nothing in this provision eliminates non-waivable consumer rights, statutory remedies, access to government agencies, or legally protected payment-dispute rights.

42. Governing law: State of Michigan

These Terms and any transaction governed by them are intended to be governed by the laws of the State of Michigan, without regard to its conflict-of-law rules, except where federal law (including the Federal Arbitration Act) or mandatory consumer-protection requirements govern. Applicable rights under the law of a consumer's state or country of residence are not displaced where they cannot lawfully be waived.

For matters that are not subject to enforceable arbitration, a competent court in Michigan may hear the dispute when jurisdiction and venue are proper. Nothing in this clause prevents a customer from bringing a claim in another court or forum where applicable law grants an unwaivable right to do so.

43. Severability, preservation of rights, and survival

If any provision or portion of these Terms is found invalid, unlawful, or unenforceable by a court or other competent authority, that provision will be enforced only to the lawful extent possible or severed if necessary. The remaining independent provisions will continue in effect, provided doing so is legally permissible and does not materially defeat the lawful purpose of the agreement.

If an arbitration requirement is unenforceable as to a particular claim or customer, the appropriate claim may proceed in a court or forum with jurisdiction without invalidating unrelated provisions of these Terms. No severability language is intended to revive a restriction barred by mandatory consumer law. Clauses that by their nature must continue after termination, such as accrued payment rights, lawful intellectual-property protections, indemnification for covered conduct, and enforceable dispute terms, survive only to the extent allowed by law.

Theater Haven's failure or delay in exercising a right under these Terms does not automatically waive that right; a waiver is effective only as permitted by law and does not imply waiver of a later breach.

44. Updates to terms and order records

We may update these Terms to reflect lawful operational changes. The effective version should be identified on the published page, and material changes should be communicated as applicable law requires. An updated page does not retroactively remove a right or benefit attached to an accepted order.

Keep copies of your order confirmation, receipt, product-specific disclosures, and relevant communications for reference. We also maintain records as required for legitimate operations and applicable legal obligations.
